J U D G M E N T 

Introduction 

The late Thomas Hutton-Mills (Esq.) can be referred to as an illustrious Ghanaian. In  his lifetime, he acquired a number of properties scattered in various places in Accra  which he passed on to his children and these properties have eventually devolved on  his great grandchildren, two of whom are the plaintiffs in this suit. One can say that  as a good father, he left behind an inheritance for his children’s children. Some of the  said properties were situate at James Town, Accra and the description of some of those  properties are H/No. D115/1 Commodore Street, James Town, Accra and H/No.  D109/1 Mills Road, James Town, Accra which are the subject matter of this present  suit. Little did he know that about 120 years after he acquired the said properties and  89 years after his death the said properties will be a subject matter of litigation.
