MASSOUD ABDULRAHMAN OREDOLA, J.C.A. (Delivering the leading Judgment): The action which gave rise to this appeal was commenced in the Ijero-Ekiti judicial Division of the High court of Ekiti state, Nigeria by the 1st respondent herein as the plaintiff where he claimed for himself and other children of Late Chief James Ibidiran Aluko of Oke Iro Street, Aramoko Ekiti, against the appellant who was sued initially as the sole defendant. However, two more defendants, including the 2nd respondent herein and one Chief Ezekiel Oyebanji Aluko were later joined in the course of proceedings before the trial court as 2nd and 3rd defendants respectively.

The action was commenced on 9th February, 2005 after the necessary leave to issue and serve court processes outside jurisdiction was sought and obtained. It was registered as Suit No.HIJ/1/2005.
