PETER-ODILI JCA (Delivering the Lead Judgment): The 1st appellant, Sule Muazu was a candidate for the office of member to the Katsina State Assembly Constituency for 14 April 2007 General Election held throughout Nigeria. The 2nd appellant, Peoples Democratic Party (PDP) sponsored the 1st appellant for the election. The 1st respondent All Nigeria Peoples Party (ANPP) sponsored the 2nd respondent Ibrahim Mamman Danmusa to contest the said election for the office of member to the Katsina State House of Assembly for Danmusa State Assembly Constituency. Other candidates were also sponsored by other political parties to contest the said election for the same office. On 14 April 2007, scheduled for the election, the election in the Danmusa Local Government Area which made up the State House of Assembly Constituencycould not hold due to violence, thuggery, intimidation and snatching of election materials by persons suspected to be hoodlums.
