(Delivering the Leading Judgment): This is an appeal against the judgment of the Court of Appeal, Kaduna Division, which dismissed the appellant’s appeal and affirmed the judgment of the High Court of Justice, Jigawa State, which had earlier convicted the appellant for the offense of culpable homicide punishable with death and sentenced him accordingly.
The appellant was arraigned on a sole count charge alleging the commission of the offense of culpable homicide punishable with death under section 221 of the Penal Code Law of Jigawa State.
Upon being arraigned, the appellant pleaded guilty to the charge, but the offense charged being a capital offense, the learned trial judge recorded a plea of not guilty for him, and the prosecution was ordered to prove its case. At the trial, the respondent and prosecution fielded four witnesses, including PW4, who was an eyewitness to the commission of the offense.
