MANGAJI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the Local Government Election Tribunal sitting in Maiduguri, Borno State. The Local Government Election Tribunal- hereinafter to be referred to simply as: the tribunal- in its judgment dated 10th February, 1999 nullified the election conducted into the office of the Chairman of the Bama Local Government Council in which the 1st respondent was declared elected on the principal ground that:-
"It is difficult for us to know exactly how many units have been cancelled in the absence of definite evidence to that effect: They may be two, six or more. This has hampered our ability to calculate the final scores of the petitioner and 1st respondent.
In the present circumstance it is our view that the best the tribunal can do is to ask the parties to return to their Local Government Areas for a clear mandate by the electorate.
