The Plaintiff initially sued the 1st Defendant, inter alia, for a declaration of title to the disputed land, an order for perpetual injunction and general damages. The 2nd Defendant was subsequently joined to the suit as a party as a result of which the Plaintiff filed an amended writ of summons on 3rd May, 2013. The Plaintiff per its amended writ of summons claimed against the Defendants for the following reliefs.

“a. A declaration that the lease agreement dated the 10th day of November, 2008, made between the Defendant herein and the Plaintiff Company whereby the Defendant leased the subject property to Plaintiff for a term of 50 years, is valid and subsisting.

b. A further declaration that by virtue of the subsistence of the said lease, any grant or purported grant of an interest in the said land to any person or persons by Defendant, is null and void ab initio.
