The Plaintiff/Respondent in this matter set out to buy a house on Plot 13, Block XXX Offinso New Site Ashanti which had been put up for auction. She purchased it for the sum of Twenty-Three Thousand Ghana Cedis (GH¢23,000) on 29th December 2010. Thereafter she was issued with a Certificate of purchase by the Circuit Court, Tepa. However, the 1st Defendant/Appellant who was living in the house refused to move out of the house. She therefore commenced this action in the Circuit Court, Offinso on 3rd January 2011 for the following reliefs:

1. An order of possession of all that H/No. Plot 13, Block XXX Offinso New Site, Ashanti.

2. An order of ejectment of the Defendant, his agents, tenants and all those who claim through him from the house mentioned in relief ‘a’ supra.

3. An order of perpetual injunction restraining the Defendant, his agents, tenants, and all those who claim through him from interfering in her quiet enjoyment of the house mentioned in relief ‘a…
