Brief facts:

This is an appeal against the judgment of the Circuit Court, Kumasi dated Monday 19th June, 2017 by Her Honour. The parties married under customary law on 22nd April, 2000, at Tachimantia in the Brong-Ahafo Region. The petitioner (Naomi Osei) filed a petition at the trial court for the following reliefs:

a. Maintenance pending trial for both Petitioner and the child of the marriage;
b. Share of two properties namely H/No. Plot 59, BLK ‘B’ Bremang Newsite and property at Afrancho Kronum acquired during the marriage;
c. Alimony;
d. That the Respondent should bear the cost in this matter.

The Respondent also cross petitioned for the following that:

a. The Petitioner’s petition and the reliefs are of nullity and must be dismissed;
b. The customary marriage between the parties be maintained;
c. The Petitioner pays all cost including incidental expenses the Respondent shall incur in this suit.
