This is an appeal against the decision of the District Court – Ejisu, Ashanti. The antecedent facts to the instant appeal before this court are as follows: the plaintiff/respondent [hereinafter referred to as the respondent) instituted legal action against the defendants/appellants (hereinafter referred to as the appellants) over a plot of land at Amoam Achiase. The land in disputed was described by the respondent as Plot No.13 Block ‘A’ located at Amoam Achiase.

The substance of the respondent’s case was that in 2017 she acquired the land in dispute from one Hajia Baby who had earlier acquired the said land from one Kwame Badu, now deceased. The respondent averred that when she acquired the land, the said Hajia Baby, with the help of one Kofi Karikari, the customary successor of the late Kwame Badu, introduced her to the Chief of Amoam Achiase, Nana Kwaku Duah I, who issued fresh allocation note to her.
