RULING 

Before me is an application for an order of the court to dismiss the suit against the Defendant/Applicant on the ground that the statement of claim discloses no reasonable cause of action against the Defendant. The application is premised on Order 11 rule 18 (1)(a) of the High Court Civil Procedure Rules, 2004 (CI 47).

On 10/07/2020, the Plaintiffs/Respondents herein filed a writ of summons against the Defendants/Applicants for:

a. Declaration that 1 Defendant under whose express instruction and direction the 2, 3, 4 and 5 Defendants acted on behalf of the 7 Defendant unlawfully.

b. Declaration that the arbitration body comprising 2, 3, 4 and 5 Defendants who acted on the express instruction and direction of 1 Defendant, had no such authority to act for and on behalf of the 7 Defendant.

c. Declaration that the decision of the arbitration panel comprising 2, 3, 4 and 5 Defendants who had no such authority to act for and on behalf of the 7 Defendant, was null and void.
