HAMMA AKAWU BARKA, JCA (Delivering the Leading Judgment): This appeal emanated from the judgment of the Honourable Justice M. O. Eneji, of the Cross River State High Court, sitting in Ikom, in suit with No. HM/64/2012; between Eche Nchor Takon Esq, as administrator of the Estate of Anthony Nkim Takon (deceased) and Chief (Mrs) Nancy Mbong Takon (Nee Ndifon) and one other, which judgment was delivered on the 3rd of November, 2015. By the said judgment, the court dismissed the claim filed by the appellant and in its stead, granted the counterclaim. Specifically, the court concluded that:
“In sum, the claimant has failed woefully to prove his claim as bona fide owner over the property situate and known as No 11 Okim Osabor Street, four Corners, Ikom, against the defendants.
Accordingly issue 6 formulated by the claimant fails and is hereby resolved in the negative.
