On 28th day of February 2014, the High Court sitting at Bolgatanga gave judgment for the Plaintiff, now the Respondents in this Appeal

The Plaintiff per his writ of summons sought the following reliefs from the Court:

1. Declaration of title to all that piece or parcel of land situate lying and being at a place commonly called Gbantirago/Bilatega and which land is bounded to the North by the farm lands of Kadri and Abigbilla to the South by the farm lands of Ziginaba and Asoyanaba to the east by Lezie’s farm land and to the west by Abagre Ayindana’s farm land and measuring in the aggregate about 100 square meters.

2. Recovery of possession of the land described in relief 1.

3. An order of perpetual injunction restraining the defendant whether the Defendant acts by himself or by his agents, workmen, successors in title or assigns from trespassing upon the said land or otherwise interfering with the Plaintiff’s interest therein.

4. General damages for trespass.
