CHIDI NWAOMA UWA, J.C.A. (Delivering the Leading Judgment): The Respondent as the claimant before the trial Court instituted this suit against the Appellant who was the Defendant/Counter Claimant vide a writ of summons and statement of claim filed on the 8th May, 2014 in the High Court of Kwara State and claimed the following reliefs:
i. A Declaration that the wrongful claim/occupation of the property situated and lying at No. 37, Karumoh street, Ilorin by the Defendant is unlawful, null and void.
ii. A Declaration that the claimants families are the only person(s) entitled to any title document(s) on the landed property.
