NGWUTA JCA (Delivering the Lead Ruling): This is a motion on notice brought pursuant to section 242 of the Constitution of the Federal Republic of Nigeria, 1999; section 25 of the Court of Appeal Act, 1990; Order 3, rule 4 of the Court of Appeal Rules, 2002, and under the inherent jurisdiction of the court.
The applicant prayed the court for the following reliefs:
“1. Enlargement of time within which to apply for leave of the Court of Appeal to cross-appeal against the judgment delivered on 22nd July, 1996. 2.
