OGEBE JCA (Delivering the Lead Judgment): The respondent on the 18th of December, 2003 filed an application before the High Court of Enugu State holden at Enugu for leave to commence proceedings for the enforcement of his fundamental rights against the respondents named in the application. The reliefs endorsed in the applicant’s statement of facts are as follows: “(i) Declaration that the bodily injuries inflicted on the applicant by 2nd respondent and two other unidentified henchmen and mobile policemen on the orders of the 3rd respondent constitute infraction of applicant’s right to dignity of his person as guaranteed under section 34 of the Constitution of the Federal Republic of Nigeria, 1999.
