MUKHTAR JCA (Delivering the Lead Judgment): This appeal emanates from the ruling of the Anambra State Governorship and Legislative Houses Election Tribunal sitting at Awka, delivered on 13 July 2010, whereby the tribunal dismissed the appellant’s application for an order for leave to adduce further evidence in the prosecution of their petition. Following the holding of governorship election in Anambra State on 6 February 2010,the 1st respondent herein, Mr. Peter Gregory Obiwas returned as the winner of the said election. The appellants having participated in that A election, were dissatisfied with the return of the 1st respondent and therefore filed a petition  on 5 March 2010 challenging the said return accompanied with list of witnesses,written statements on oath of witnesses and list of documents to be relied upon at the trial (see pages 1-18 of the record).
