MUSA DATTIJO MUHAMMAD, J.S.C. (Delivering the Leading Judgment): This is an appeal against the decision of the Owerri Division of the Court of Appeal (hereinafter referred to as the court below) delivered on 18th April, 2011 affirming the decision of the Imo State High Court, (hereinafter referred to as the trial court) convicting the appellant for the offences of conspiracy and Armed Robbery in charge HOW/51C/99 and sentencing her to death.

The appellant and the 1st accused person were tried on a two count Charge of Conspiracy and Armed Robbery contrary to Sections 5(b) and 1(2) of the Robbery and Firearms (Special Provisions) Act CAP 398 Laws of the Federation 1990 respectively.
