(Delivering the Leading Judgment): This appeal is against the judgment of the Federal High Court, Lagos Division delivered by Honourable Justice Saliu Saidu on the 2nd December, 2013. The Applicant now Respondent in this appeal, on the 14th November, 2012 filed an application for the enforcement of his fundamental rights against the Respondent at the Court below now Appellant seeking the following reliefs:-

1. A declaration that the seizure and detention of the applicant vehicle, TV set and other personal belongings as listed below is unlawful.

a) A Volkswagen Golf 3 Wagon with Registration No. FC 865 LND, Engine No, AAM 614270 and Chasis No. WWW2221H2VW411536 valued N750, 000.00

b) The sum of N450,000 (Four Hundred and Fifty Thousand Naira) Cash.

c) A leather Box Containing 4 pairs of trouser valued - N35, 000

d) 4 packets of Shirts valued - N20, 000

e) 2 pairs of male shoe valued - N5, 000

f) 1 pair of female shoe valued at - N2, 000

g) 1 "17" LCD Televis…
