(DELIVERING THE LEADING JUDGMENT): This appeal is against the judgment of the Federal High Court of 3rd March, 2021 as was rendered by Lewis-Allagoa, J. in suit No. FHC/KN/CS/137/2018. The respondents as claimants in the Federal High Court claimed against the appellant as sole defendant:

  1. A. declaration that the spewing/spilling of condensate liquid gas to Kosawa Village near Kano between the 21st of May 2018 which continued till about the 26th of June 2018 from the 18” high-pressure surface pipeline owned and operated by the defendant to land, lake and terrain, inflicting injuries to the vegetation, ecosystem, ecology, services and claimants within and outside the Right of Way (R.O.W.) of the said pipeline amounts/constitutes negligence against the defendant and also makes the defendant liable and/or culpable under the rule in Rylands v. Fletcher (1898) L.R.3. H.L 330.

  2. A declaration that the purported Joint Investigation Visit (JIV) done in Kosawa Community…
