BULKACHUWA JCA (Delivering the Lead Judgment): The

respondent as plaintiff before the trial court took out a writ of summons dated the 17th June, 1993, whereby he claimed the following reliefs against the appellants as defendants jointly and severally; 

(a) Damages for pains and suffering - N500,000.00

(b) Damages for loss of amenities of life - N500,000.00

                     N1,000,000.00

Parties joined issues before the lower court in their respective pleadings, the matter went on trial at the end of which the trial court found for the plaintiff/respondent in its judgment of 1/9/1998 and the respondent was awarded N400,000.00 as damages for pains and suffering and N200,000.00 as damages for loss of amenities of life.

The defendants/appellants being dissatisfied with the said decision filed an appeal on the 4/9/98 on five grounds of appeal and an amended notice of appeal containing12 grounds of appeal and with the leave of court granted on the 8/4/2003 filed 7 additional grounds of appe…
