ELFRIEDA OLUWAYEMISI WILLIAMS-DAWODU, J.C.A.(Delivering the Leading Judgment): This appeal was filed against the Judgment of the Yobe State High Court, Damaturu, delivered on April 4th 2005 by Hon. Justice S. Gujba, the Chief Judge, in favour of the Respondents (the plaintiffs at the Court below) who were awarded damages in the sum of Eight Million, five hundred and fifty thousand Naira ( N8,550,000.00) only.
The case of the Respondents before the Court below was that one Alibe Ali, driver to the Appellant drove so negligently that he crashed into the parked vehicle of the deceased, one Alhaji Sale Ado, who was the husband to the 1st and 2nd Respondents and the son to the 3rd Respondent respectively.
The Appellant's Notice and Grounds of Appeal dated 2nd May 2005 contained Fourteen (14) Grounds of appeal.
