MOHAMMED LAWAL GARBA, J.C.A. (Delivering the Leading Judgment): The Appellant had sued the Respondents before the Federal High Court sitting in Lagos, vide originating summons filed on 9th of January, 2001, by which answers were sought for the following questions:-

"QUESTIONS:

1. Whether the relevant Laws in Nigeria especially, Decree No. 24 Cap 111 Laws of the Federation of Nigeria 1990 allows the Defendants to practice the profession of Estate Surveying and valuation hereinafter referred to as the "Profession".

2. Whether Decree No.24 Cap 111 Law of the Federation 1990 confers sole authority on the Plaintiff the practice of the profession aforementioned.

3. Resulting from the answers from questions (1) and (2) above, whether the contract awarded to Hydra Properties Limited by the Federal Ministry of works and Housing in contract No.3278 dated 15/11/2000 to undertake the Surveying and Valuation of Economic trees and other properties along Otta-Abeokuta axis of the proposed Otta-Abeokuta …
