JUDGMENT
The Plaintiffs issued out a Writ filed on 30th October 2015 against the Defendant per the following reliefs:
1. Declaration of title to all that piece or parcel of land described in the schedule contained in paragraph 1 of the Statement of Claim.
2. A declaration that Defendant has trespassed on a parcel of land that forms part of plaintiff’s land.
3. An order for the demolition of the structures that has been erected by the Defendant on the Plaintiffs land.
4. Perpetual injunction, restraining the Defendant from laying any future claim to Plaintiff’s land.
5. General damages for trespass.
The Defendant was served with the writ of summons and statement of claim on 2nd November 2015 but he neither entered appearance nor filed a defence. The Plaintiffs filed a Motion on Notice for Interlocutory Judgment in Default of Defence and served the Defendant with same on 17th December 2015 and hearing notice for 18th January 2016.
