EJIWUNMI, J.C.A. (Delivering the Leading Judgment): The ruling which is the subject of this appeal was sequel to the writ of summons issued in the lower court in suit No. E/358/94 where the claims of the plaintiff Mr. Samuel Aneke before that court are for the following reliefs:-

(1)A declaration that the letter Ref. No. ELG/AD/S.518/VOL.III/37 dated 29th June, 1994 signed by the defendant purportedly terminating the contract agreement between the plaintiff and Enugu North Local Government is contrary to the agreement dated 23rd August, 1991 between the plaintiff and Enugu North Local Government (sic) and therefore null and void and of no effect whatsoever.

(2)A declaration that the defendant, his servants, agents, privies and or any other person acting through or for him cannot terminate the plaintiff's contract agreement with Enugu North Local Government except in accordance with and in the manner prescribed in the Deed dated 23rd August, 1991 between the plaintiffs and Enugu North Lo…
