MASSOUD ABDULRAHMAN OREDOLA, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of High Court of Abia State sitting at Obehie, coram: Hon. Justice S. N. Imo, J., (hereinafter referred to as the lower Court and learned trial judge, respectively), delivered on the 8th day of December, 2005.

The suit which gave rise to this appeal was commenced by the plaintiff/appellant (hereinafter referred to as the appellant), wherein the appellant by his writ of summons and subsequent statement of claim, sought for the grant of the following reliefs jointly and severally against the respondents:

(i) The sum of N20 Million as special and general damages for their unlawful entry into NKPUTU UKWU landed property of the Plaintiff as HOLDER in possession pre-October 2000 of defendants trespass, by virtue of the combined effect of an Irrevocable Power of Attorney dated 5th February, 1987 executed by the representatives of Obiga Village Asa in Ukwa West LGA of Abia State and regist…
