OGUNTADE, J.C.A. (Delivering the Leading Ruling): In suit No. LD/264/88, the respondent as plaintiff obtained judgment against the applicant and another company Mannesman - Aulagenbau A.G.- as 2nd and 1st defendants respectively.
The judgment, delivered on 25/1/2000 by Segun, Chief Judge of the Lagos State High Court in its conclusion reads:
"In the final result and for all the reasons given above and consequent upon the failure of the lsl defendant to pay any commission to the plaintiff as proved in the evidence, I will give judgment in favour of the plaintiff against the 1st and 2nd defendants jointly and severally as follows as contained in schedule B of their statement of claim:
1.$1,220,185.40 (U.S.Dollars)
2.£547,185.00 (Sterling)
3.DM 22,270,922.00 (Dutch Marks)
4.N2,764,785.40 (Naira)
5.$750,000.00 being 5% commission of contract D.
The 1st and 2nd defendants shall pay interest on the above sums at the rate of 13% per annum from 10th April, 1987 until payment thereof of all the sums.
