INTRODUCTION

[1] My Lords, from the outset, the facts of this case were not complicated whatsoever. However, over time, the proceedings became more complicated than the facts, leading to the pendency of the case in the court below from 2013 when it commenced at the erstwhile Fast Track High Court to the year 2020 when that court delivered its judgment in favour of the respondent herein. Indeed, it has taken an additional five years for the instant appeal to be heard and judgment delivered.

Thus, cumulatively, the instant case has been pending in our courts for more than twelve years. Should the unsuccessful party decide to climb up to the Supreme Court, only God knows how long the parties will have to endure further the obvious anxiety, despondency and expenditure of energy and resources that run with the inordinate pendency of cases in our courts.
