MOHAMMED, J.C.A. (Delivering the Leading Judgment): This appeal is against the decision of the Kano State High Court of Justice delivered on 20/12/93 in which the learned trial Judge declared the dismissal of the respondent from the services of the appellant company as wrongful and therefore awarded the sum of N20,596.66 as retirement benefits and N20,000.00 as general damages to the respondent. The appellant which was not satisfied with part of that decision had appealed against it by a Notice of Appeal containing 4 grounds of appeal from which 2 issues were identified by both parties in their respective briefs of argument for the determination of the appeal.

The facts leading to the decision of the lower court can be summarised as follows. The respondent was employed by the appellant as a clerk in December 1966 and rose to the position of Production Officer.
