ITA GEORGE MBABA, J.C.A. (Delivering the Leading Judgment): This appeal is against the interlocutory decision of Enugu State High Court in suit no. E/204/2018, delivered on 1/7/2019 by Hon. Justice C. O Ajah, wherein the learned trial judge dismissed the Notice of Preliminary objection, raised by the 1st Defendant to stop the trial, holding that he had jurisdiction to entertain the suit.
At the trial Court, the plaintiff (now 1st Respondent) had sought the following reliefs against the Defendants (now Appellants):
1) A declaration that the plaintiff purchased from Umuenwene Iji Nike Community a parcel of land known as Plot CR/30, initially, measuring approximately 2201.491 square meters and later 773.320 square meters, situated along Enugu Abakaliki Express Road, Enugu, Enugu East Local Government Area of Enugu State.
