HABEEB ADEWALE OLUMUYIWA ABIRU, J.C.A.(Delivering the Leading Judgment): This appeal is against the judgment of the High Court of Plateau State in Suit No PLD/J286/2006 delivered by Honorable Justice Y. G. Dakwak on the 17th of October 2008.
The first Respondents, as claimants, commenced the action in the lower Court against the second to the fifth Respondents and the Appellants as the first to the tenth defendants. The facts leading up to the action were that Plateau State Government created development areas in the State and one of which was Namu Development Area with headquarters in Namu. Conflicts arose between the two main tribes, Goemai Community and Koffyar Community, over the use of the name Namu for the Development Area and the conflicts turned violent and in the course of which lives were lost.
