JUDGMENT

DZAMEFE, JA

This is an appeal by the 1st defendant hereinafter referred to as the appellant against the judgment of the High Court Accra, dated 12th April 2011 in favour of the plaintiff hereinafter referred to as the respondent. The respondent in his statement of claim stated that he represents the Osabu and Ayiku Wulomo of Teshie and also the trustee and custodian of the lands of Kle Musum Quarters of Teshie and We family.  He is also the custodian of land registered in the Deeds Registry as No.1332/65. That the Supreme Court in suit No.8/92 and judgment dated 19th April 1994 adjudged that the beneficiary interest in document No.1332/65 resides only in the Tsie-We family of Teshie.

The Supreme Court also made a finding of fact that only the Wulomo and elders of Tsie-We can alienate lands described in that document, No.1332/65.  The respondent avers that the appellant has appropriated about 100 acres of their lands without their consent.  According to him the 2nd and 3rd defend…
