AYOBODE OLUJIMI LOKULO-SODIPE, J.C.A. (Delivering the Lead Ruling): The motion on notice before the Court dated 11/2/2019 and filed on 21/2/2019, was brought by the Appellant as Applicant pursuant to Order 6 Rules 1, 4 and 9 of the Court of Appeal Rules, 2016 and therein the Applicant seeks for the following orders: -
“A. An order of extension of time within which to seek leave to appeal against the judgment by the justices (sic) of the Customary Court of Appeal of Imo State (sic) as led by Hon. Justice Christiana Ukachi Anwukah (acting president) (of blessed memory) on the 15th day of June, 2018 in this Appeal No. CCA/OW/A/105/2017 between Elder Livinus Nwachukwu and Samuel Ndukwu
B. An order of leave to appeal against the said judgment delivered in the aforesaid Appeal No: CCA/OW/A/105/2017 by the aforesaid justices (sic) of the Customary Court of Appeal Owerri, Imo State.
