YARGATA BYENCHIT NIMPAR, J.C.A. (Delivering the Leading Judgment): This Appeal is against the decision of the High Court of Nasarawa State sitting in Lafia and delivered by HON. JUSTICE DANJUMA A. OYEGBENUM on the 13th December, 2016 wherein the lower Court dismissed the claim of the Appellant and entered judgment in favour of the 3rd Respondent, awarded the land to the 3rd Respondent with the adjacent land that was not in dispute in the counterclaim. The trial Judge proceeded to dismiss the case of the Appellant. The Counter claim of the 3rd Respondent succeeded simply on the grounds that no separate defence to the counter claim was filed. The Appellant dissatisfied with the decision, filed a Notice of Appeal on the 26th day of January, 2017 setting out 18 grounds of Appeal.
