TUNDE OYEBANJI AWOTOYE, J.C.A. (Delivering the Leading Judgment): This is the judgment in respect of the appeal of the Plaintiff (now Appellant) against the decision of Federal High Court sitting at Umuahia delivered on 10/3/2014.

The Plaintiffs claims at the lower court are as per paragraphs 11-15 of his Amended Statement of claim which was amended pursuant to an order of court granted on 30/1/2013.

The said paragraphs 11-15 reads thus:

11 WHEREFORE THE 1ST PLAINTIFF CLAIMS against the Defendants jointly and severally as follows:

A Special Damages: N73,743,400.00

PARTICULARS OF SPECIAL DAMAGES

i. N6,715,000.00 being the monitory value of the 1st Plaintiff goods seized by the 1st Defendant as per paragraph 4 above.

ii. N77,400.00 being the cost of medical bills at Zenith Hospital and as per paragraphs 10(b) and (c) herein above.

iii. N3,120,000.00 being the total sum lost in daily earning at the rate of N15.000.00 per day for months as per paragraph 10(e) above.
