SIDI DAUDA BAGE, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of Esan J. of the High court of Justice, Oyo State holden at Ibadan in Ibadan Judicial Division in charge No. 1/46c/2004, THE STATE v. OBINA JOHN, OBASI ONYEYE, OKECHUKWU NWESI (APPELLANT) delivered on the 9th of November, 2006. The Appellant and the two other accused persons in the court below were charge as follows:-
