IKONGBEH JCA (Delivering the Lead Judgment): The appellant herein was the plaintiff before the Federal High Court, sitting at Ilorin. She was until 22/09/99 in the service of the 1st defendant/respondent as a reader (associate professor) in the Department of Guidance and Counselling, Faculty of Education. On that date, a letter (exhibit 20 before the trial court) was addressed to her by Mrs. M. A. Ololade (DW1), who wrote on behalf of the registrar (2nd defendant/respondent), informing her, inter alia , that the appointments and promotions committee, after considering her failure to resume duty at the end of her approved leave of absence, had decided that she should be deemed to have voluntarily terminated her appointment with the 1st respondent with effect from 17th April, 1999, the date she ought to have resumed duty at the expiration of her leave of absence.
