HABEEB ADEWALE OLUMUYIWA ABIRU, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the High Court of Plateau State delivered in Suit No PLD/J/197/2008 by Honorable Justice Y. G. Dakwak on the 222nd of September 2014. The Respondent was the plaintiff in the lower Court and his claims against the Appellants were for:
i. The return of seven drums of engine oil, sixty containers of twenty-five litres of engine oil worth the sum of N253,500.00 and physical cash of the sum of N40,000.00 which the Appellants took away from his shop at Satellite Market Rukuba Road Jos on the 23rd day of May 2008 Or in the alternative, the sum of N293,500.00 being the monetary value of the removed items and physical cash taken.
ii. The sum of N2 Million as general damages for the unlawful breaking of his shop, destruction of his shop by the Appellants, the mental agony and loss of earnings from the business and for locking up his shop without legal justification.
