TOBI, J.C.A. (Delivering the Leading Ruling): On 20th May, 1991, this court delivered judgment in favour of the respondent. The appellant and Bronik Motors Ltd were ordered to pay immediately arrears of monthly instalmental payments of the judgment debt from 17/6/91 amounting to a sum of N1,800,000.00. They were also ordered to pay a monthly instalment of N25,000.00 thereafter.

Dissatisfied with the judgment, the appellant filed a Notice of Appeal. He also filed an application for stay of execution of the judgment of this court pending the determination of the appeal to the Supreme Court. The application is supported by a 10-paragraph affidavit, and a further affidavit. The respondent, through one Mrs. Sidikat Ashiru, has sworn a 15-paragraph counter affidavit. And so the parties have joined issues on the application.
