MOHAMMED LAWAL GARBA, JSC (Delivering the Lead Judgment): By way of "WRIT OF SUMMONS FOR LAND SUIT", filed on 16th September, 2013 before the Enugu State High Court, at page 1 of Record of Appeal, the Respondents sued the Appellants; jointly and severally and claimed as follows:-
"(a) N2,000,000.00 (two million naira) special and general damages for trespass to the said land.
Particulars of special Damages
i. Cost of rebuilding the extension of the piggery house knocked down. N400,000.00 (four hundred thousand naira).
ii. Cost of rebuilding the extension of the quest chalet knocked down 600,000.00 (six hundred thousand naira).
(b) A perpetual injunction restraining the defendants, their agents or privies from committing further acts of trespass to the said land, the boundaries of which one are delineated in survey plan No. 1N/GA/1256/77 incorporated in survey plan No. FCO/EN/V.5/2004 filed by the plaintiffs or in any manner whatsoever interfering with the plaintiff's possession and user or…
