MUKHTAR, JCA (Delivering the Lead Judgment): In the court below, the respondent who was the plaintiff instituted an action against the appellant for the following reliefs as per the content of the statement of claim.

“A. SPECIAL DAMAGES

The sum of N200,000 being the current purchase price of the engine of a Mercedes Benz 230 Saloon Car.

The sum of N15,000 being the current purchase price of his car stereo. A The sum of N600 being the amount advanced to the defendant for repairs which he did not effect.

The sum of N1,500 being cost of rear sunshades removed from the plaintiff’s vehicle.

The sum of N3,500 being current purchase price of the plaintiff’s battery.

The sum of N12,000 being current purchase price of plaintiff’s missing fuel pump.

The sum of N20,000 being current purchase price of plaintiff’s missing top cylinder.

GENERAL DAMAGES

The sum of N100,000 as general damages.

The cost of this suit.

Any further costs as the Honourable Court may deem appropriate in the circumstances.”
