AKANBI, P.C.A. (Delivering the Ruling of the Court): This is a very unfortunate case. An appeal of a case which was concluded in the High Court since 1987 is yet to be transmitted to this court. The appellant did comply with all the conditions of appeal after due settlement of the record in 1989: yet unfortunately, the High Court, has not seen fit to type out the proceeding notwithstanding the fact that apart from paying the fees for the compilation of the record and depositing the security for costs ordered, the appellants went out of their way to supply stencils for the production of the record. Mr. Effiong. Assistant Chief Registrar in Lagos State High Court who appeared for both the Principal Registrar Mr. Sejoro and Mr. Imaralu Senior Registrar (appeals) informed us that the stencils have all gone stale and the entire record may have to be re-typed on new stencils.
