JEGA JCA (Delivering the Lead Judgment): This is an appeal against the decision of the Federal High Court, Kaduna delivered on 16th December, 2004 in charge No. FHC/KD/144C/2004 by Hon. Justice A. M. Liman. The facts of this case as can be seen from the record of appeal before the court are as stated thus:-

The appellant was charged before the Federal High Court Kadunaalong with the 2nd to 8th respondents herein on a 4 count charge under the Miscellaneous Offences Decree as amended by the Tribunals (Certain Consequential Amendments etc.) Decree No. 62 of 1999. The appellant was also charged along with the 2nd to 8th respondents on a two count charge in charge No. FHC/KD/143c/2004 under the Money Laundering Decree No. 3 of 1995. The accused persons were arraigned before the court on the 7th December, 2004. The court refused oral applications for bail made on their behalf on that day and ordered formal applications to be filed. The learned trial Judge adjourned the case to 13th Decembe…
