AIMEPOMO JCA (Delivering the Lead Judgment): This is an appeal from the decision of the Hon. Justice U. Nri-Ezedi of Awka High Court in the Awka Judicial Division of Anambra State of Nigeria delivered on 28 May 2004. In the decision, judgment was given against the appellant who was the plaintiff in the court below. In that court, the plaintiff sought relief against the defendants jointly and severally as follows:
“An order directing the defendants to prepare a comprehensive A account of the administration of the estate of late Hugh Michael Odiari from inception till date and file same in this court within such time as the court shall stipulate.
