(Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of Ondo State Akure Judicial Division delivered on the 16th of December, 2019 in Suit No. AK/124C/2018, whereby the Appellant was sentenced to death for conspiring to commit Armed Robbery and Armed Robbery contrary to Section 6(b) and Section 1(2)(a) respectively of the Robbery and Firearms (Special Provisions) Act, Cap R. 11. Vol. 14. Laws of the Federation of Nigeria 2004.

FACTS OF THE CASE

The Appellant, Charles Odili was tried on a two counts charge of conspiracy to commit armed Robbery and Armed Robbery contrary to Section 6(b) and Section 1(2)(a) of the Robbery and Firearms (Special Provisions) Act Cap. R 11 Vol. 14 Laws of the Federation of Nigeria 2004.
