ADEKEYE, JCA (Delivering the Lead Judgment) : The endorsement on the writ of summons and paragraph 21 of the statement of claim in Suit No 11349194 before the High Court of Justice Oyo State Ibadan Judicial Division put the claim of the plaintiff named Akin Akinyemi (Trading under the name and style of Akin Akinyemi Associates) as follows:

(1) Declaration that the total sum of N365,481.00 paid by the defendants to the plaintiff does not represent proper, adequate and fair remuneration due to the plaintiff for his professional services in carrying out evaluation of some assets of three subsidiary companies of the defendant on the instruction of the defendant.

(2) An order directing the defendant to pay to the plaintiff the sum of N1,119,899.40 as any other sum as upon a quantum meruit representing, the balance due and payable to him for his said professional services.
