EBERECHI SUZZETTE NYESOM-WIKE, J.C.A. (Delivering the Lead Judgment): This is an appeal against the judgment of High Court of Justice, Niger State, Kontagora Division delivered by Hon. Justice Binta Bawa on 2nd March, 2023.
The facts are that by the Plaintiff’s (Appellant’s) amended statement of claim, he claimed against the Defendants (Respondents) declaration of title to land, injunction and damages over the parcel of land located behind Had Resources Hotel Limited at BCJA Kontagora, Niger State. The Respondents counterclaimed against the Appellant for declaration in favour of their Right of Occupancy covered by Grant No. NGS 849. After hearing, the learned trial Judge dismissed the Appellant’s claims and granted the Respondents’ counterclaim. Hence, this appeal by the Appellant.
