YARGATA BYENCHIT NIMPAR, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the Lagos State High Court delivered on the 25th of February, 2008 by HON. JUSTICE K. O. ALOGBA wherein the claim of the Appellants was dismissed. Aggrieved by the said decision, the Appellants filed an Amended Notice of Appeal dated 27th October, 2016 filed same day setting out 5 grounds of Appeal.

The Appellants were the claimants before the lower Court and by a 2nd Amended Statement of Claim dated 14th November, 2006 they claimed the following reliefs:

"(a) A declaration that the claimants are entitled to monetary and landed compensation by virtue of the 1st Defendant's letter in respect of the compulsory acquisition of the landed property situate, lying and being at Shangisha - Magodo Scheme II

(b) An Order for the payment by the defendants to the claimants on account of the undertaking contained in the said letter of 21st January, 1994 a sum of N100 million.
