ADAMU, J.C.A. (Delivering the Leading Judgment): In the Chairmanship election to local government council nation-wide which took place on 15/3/97, the 1st respondent/appellant contested for the chairmanship of Iseyin Local Government Council of Oyo State under the platform of C.N.C. The petitioner also contested in the said election and for the same post under the platform of D.P.N. Other candidates also contested for the same post under the banner of their respective parties. At the end of the election, the 1st respondent/appellant Mr. Adeoti Bolanle Olalekan emerged as the winner by scoring 10,841 votes and he was declared by NECON as the duly and lawfully elected chairman. The petitioner/respondent Mr. Muraina Remi Ogundiran, who scored 10,262 votes next to the respondent and who lost to the latter was not satisfied with the result of the election and he petitioned against it to the Local Government Election Petition Tribunal of Oyo State sitting at Ibadan.
