OGUNBIYI JCA (Delivering the Lead Judgment): This is an appeal against the ruling of the Governorship and Legislative Houses Election Tribunal, Abeokuta, Ogun State delivered on 17 August 2008 wherein the honourable tribunaldismissed the petition ashaving been abandoned pursuant to paragraph 3(4) of the Election Tribunal and Court Practice Directions, 2007. The facts of the case are that the appellant was the candidate of the ANPP under whose sponsorship he participated as candidate in the election into the Ogun State House of Assembly seeking to represent the Ijebu North Constituency at the said Assembly. The electionswere conducted into the said House of Assembly on 14 April 2007, and the 3rd respondent (Adegbesari J. F.) being the candidate of the 13th respondent (Peoples’ Democratic Party) was declared the winner by the 1st, 2nd, 4th-11th respondents (INEC).
