OMAGE JCA (Delivering the Lead Judgment): In this appeal, the appellants were dissatisfied with the judgment of the court below; the High Court of Justice, Oyo State, in Eruwa, presided over by the Honourable Justice A. Adeniran. The Honourable court in its judgment delivered on 7th May, 1996, made the following declarations:- (1) That the plaintiffs are the persons entitled to the customary right of occupancy to the piece or parcel of land situate, lying and being at Igbo Ipere and Igbo Ede in Bakasa land, Idere, Ifeloju Local Government Area, which said piece or parcel of land is described and verged “green” on survey plan No. OY/ 0579/93/998, hereinafter called the said land.

(2) An order of forfeiture of the defendants’ holding of the said land.

Possession of the said land.

Injunction restraining the defendants, their servants and or agents from trespassing on the said land.”
